Judge Rules Transgender Woman Accused Of Flashing Penis At Ohio YMCA Is 'Too Fat' For Her Genitals To Show, Finding Her Not Guilty

According to reports, Judge David McNamee of Xenia County, Ohio, decided that Rachel Glines, a transgender woman who used to go by the name Darren before the year 2021, did not engage in indecent exposure earlier this year while she was in a female locker room at the Xenia YMCA.
In February, it was first reported that Glines was charged with three charges of indecent exposure after witnesses allegedly told women, including minors, that they saw a "naked man" with a visible penis in the women's restroom.
The defense claimed in court that their client was not indecently displayed since her body fat concealed her genital region.

Ultimately, Judge McNamee agreed and absolved Glines of her accusations, noting that there was "little dispute as to the facts of the case," particularly with regard to the defendant having permission to enter the locker room in the first place and that she was also overweight and had body fat covering her penis.
There is no doubt that [Glines] was in the women's locker area, according to Judge McNamee. However, [Glines] was not charged with trespassing nor was [Glines] accused of being in an unauthorized part of the YMCA. Simply put, the evidence is lacking to prove claims of guilt. Glines' genitalia were concealed by other parts of her body, therefore they were not visible.
The defense team also pointed out that the YMCA of Greater Dayton had previously granted Glines permission to use all other facilities in the neighborhood as well as the women's locker room at the location she was at.
"Under no circumstances will we investigate an individual's birth identity and then assign individuals to locker rooms," the YMCA said in a statement following the event. That would be against the law, against respecting everyone, and against who or what our organization is.
